These Terms of Service govern your use of the website onehappykale.com (the "Site") and any services provided by Onehappykale, LLC, including but not limited to the Signature Wellness Program and personal health coaching (collectively, the "Services").
By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
By using this Site, you represent that you are at least 18 years of age. We reserve the right to update these Terms at any time. Your continued use of the Site following any changes constitutes acceptance of those changes.
Onehappykale, LLC is a health coaching practice, not a medical clinic. The Services and content provided are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider regarding any medical condition, and never disregard or delay seeking professional medical advice because of something you have read on this Site.
All content on this Site—including text, quiz results, graphics, logos, images, and coaching materials—is the exclusive property of Onehappykale, LLC. You are granted a limited license to access this content for personal, non-commercial use. You may not use, reproduce, or distribute our intellectual property without express written permission.
Our coaching Services are designed to support your wellness goals through holistic practices. By enrolling, you acknowledge that you are solely responsible for your own health decisions, actions, and results. While we strive to provide the best guidance possible, we make no guarantees regarding specific health outcomes or weight loss.
Payments are processed through secure third-party platforms (e.g., Practice Better, Stripe, or Affirm), and you agree to provide accurate billing information. If you choose a financing option such as Affirm, you are entering into a separate legal agreement with that provider and are responsible for their specific terms and interest rates—see Section 6 below. Failure to complete payments may result in the immediate suspension of coaching Services and access to program materials.
Rates from 0–36% APR. Payment options through Affirm are subject to an eligibility check and are provided by these lending partners: affirm.com/lenders. Options depend on your purchase amount, and a down payment may be required. CA residents: Loans by Affirm Loan Services, LLC are made or arranged pursuant to a California Financing Law license. For licenses and disclosures, see affirm.com/licenses. For example, an $800 purchase could be split into 12 monthly payments of $72.21 at 15% APR. Due to the nature of digital content and personalized coaching, all payments for Services are non-refundable. We require at least 24 hours' notice for any session cancellation or rescheduling request. Failure to provide 24 hours' notice, or "no-showing" for a scheduled session, will result in the forfeiture of that session without a refund.
To the fullest extent permitted by law, Onehappykale, LLC and its owners shall not be liable for any direct, indirect, or consequential damages arising from your use of the Site or Services. Your use of the Site and reliance on any information provided is solely at your own risk.
These Terms are governed by the laws of the State of New York. Any disputes arising from these Terms shall be resolved in the courts located in Cattaraugus County, NY.
